TonfotosSync tries to connect using the last known IP address. If your phone and computer are on the same network and the app can reach that IP, the backup will work without an internet connection.
If the IP has changed or the devices are on different networks, an internet connection is needed to establish a new connection.

Yes. Unlike cloud services, we don't have servers that store your photos. The data travels directly from your phone to your PC. We never see your photos.
